Drawlings — End User License Agreement (EULA)

This End User License Agreement ("Agreement") is between you and Gabriel Camacho ("we", "us"), the developer of the Drawlings app ("the App"). By downloading or using the App you agree to this Agreement. If you do not agree, do not use the App. If the App is used by a child, the parent or guardian accepts this Agreement on the child's behalf.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App is licensed, not sold. You may not copy, modify, reverse-engineer, decompile, rent, lend, sell or redistribute the App or any part of it, except where applicable law expressly allows it.

2. Your drawings

The drawings, photos, names and characters you create belong to you. They are processed and stored only on your device; we never receive them. You are responsible for what you photograph or draw.

3. Drawlings Plus (purchases)

Some content (such as the full story library) requires Drawlings Plus, offered as an auto-renewable subscription (monthly or yearly, the yearly plan may include a free trial) or as a one-time purchase ("Forever").

Payment is charged to your Apple ID account when you confirm the purchase.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. The renewal is charged within the 24 hours before the period ends.
You can manage or cancel subscriptions in your App Store account settings. Any unused part of a free trial is forfeited when you buy a subscription.
Purchases can be shared with your family through Family Sharing.
Refunds are handled by Apple under its policies; we cannot issue refunds ourselves.
Content included in Drawlings Plus may change over time; we aim to add new stories regularly.

4. AI-generated voices — use restrictions

The narrator and character voices in the App are generated by artificial intelligence, entirely on your device, using the Supertonic model by Supertone Inc., which is licensed under the BigScience OpenRAIL-M licence. All audio produced by these voices is machine generated. As required by that licence, the following use restrictions form an enforceable part of this Agreement. You agree not to use the App, the voice model or any audio it produces:

(a) in any way that violates any applicable national, federal, state, local or international law or regulation;

(b) for the purpose of exploiting, harming or attempting to exploit or harm minors in any way;

(d) to generate or disseminate personal identifiable information that can be used to harm an individual;

(e) to generate or disseminate information and/or content, and place it in any context, without expressly and intelligibly disclaiming that the information and/or content is machine generated;

(f) to defame, disparage or otherwise harass others;

(g) to impersonate or attempt to impersonate (e.g. deepfakes) others without their consent;

(h) for fully automated decision making that adversely impacts an individual's legal rights or otherwise creates or modifies a binding, enforceable obligation;

(i) for any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behaviour or known or predicted personal or personality characteristics;

(j) to exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behaviour of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;

(k) for any use intended to or which has the effect of discriminating against individuals or groups based on legally protected characteristics or categories;

(l) to provide medical advice and medical results interpretation;

(m) to generate or disseminate information for the purpose to be used for administration of justice, law enforcement, immigration or asylum processes, such as predicting an individual will commit fraud/crime commitment.

A copy of the OpenRAIL-M licence is included in the App (Settings › Credits).

5. Third-party components

The App includes third-party components under their own licences (for example the Animated Drawings pose model by Meta, MIT; ONNX Runtime by Microsoft, MIT; the Baloo 2 and Nunito fonts, SIL Open Font License; Supertonic by Supertone, OpenRAIL-M). Their notices are listed in Settings › Credits.

6. Privacy

The App does not collect personal data. See our Privacy Policy, available in the App (Settings › Privacy) and on the App Store page.

7. Disclaimer and limitation of liability

The App is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, and we are not liable for any indirect, incidental or consequential damages, or for any loss of data, arising from your use of the App. Nothing in this Agreement limits any rights you have as a consumer that cannot be limited by law.

8. Termination

This licence ends automatically if you breach this Agreement. On termination you must stop using the App and delete it.

9. Apple

This Agreement is between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any product claims, including product liability, legal or regulatory compliance, or intellectual-property claims; we are responsible for those to the extent required by this Agreement and by law. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

10. Changes and governing law

We may update this Agreement; the current version is always available in the App. This Agreement is governed by the laws of Spain, without prejudice to the mandatory consumer protection rules of your country of residence.
